Does the written version of the jury's instructions need to be given to the jury during deliberations?

California, United States of America

The following excerpt is from People v. Rouse, H034647 (Cal. App. 2012):

8. We quote the written version of the instruction in this opinion. The trial court stated that it would give the jury copies of the written instructions for use during deliberations and the record offers no reason to doubt that it did so. In these circumstances (People v. Wilson, supra, 44 Cal.4th at p. 802) "[t]o the extent a discrepancy exists between the written and oral versions of jury instructions, the written instructions provided to the jury will control." (Id. at p. 803; accord, id. at p. 804.)
