The following excerpt is from People v. Carter, A145062 (Cal. App. 2017):

Crimes Against the Person, 245, p.1071.)2 Defendant contends the trial court erred in failing to instruct on imperfect self-defense as a lesser included offense of murder. We independently review defendant's claim of instructional error (People v. Waidla (2000) 22 Cal.4th 690, 733; People v. Cooksey (2002) 95 Cal.App.4th 1407, 1411), and we conclude there was no error.
