Does the Court have jurisdiction to make a "exceptional and extremely unusual hardship" determination?

MultiRegion, United States of America

The following excerpt is from Tampubolon V. Holder Jr., No. 06-70811, No.A095-630-032, No.A097-854-046 (9th Cir. 2010):

(9th Cir. 2003) (holding that the " 'exceptional and extremely unusual hardship' determination is a subjective, discretionary judgment that has been carved out of our appellate jurisdiction"). This court retains jurisdiction, however, to review due process challenges and other questions of law. See, e.g., Martinez-Rosas v. Gonzales, 424 F.3d 926, 930 (9th Cir. 2005). We review our own jurisdiction de novo. Taslimi, 590 F.3d at 984.
