The following excerpt is from People v. Montoya, G056429 (Cal. App. 2019):
In the respondent's brief, the Attorney General agrees that defendant had served 995 actual days in presentence custody and that the abstract of judgment should be corrected accordingly. As defendant is entitled to 995 days of credit for actual time served, we direct the trial court to modify the judgment and correct the abstract of judgment to reflect the correct number of days of presentence custody credits to which defendant is entitled. (See People v. Magallanes (2009) 173 Cal.App.4th 529, 537.)
