This court has not directly addressed such a situation, Thomas v. Cardwell, 626 F.2d 1375, 1385 n. 33 (9th Cir.1980), cert. denied, 449 U.S. 1089, 101 S.Ct. 881, 66 L.Ed.2d 816 (1981), and this case does not present it. Here the witness testified fully on direct examination and was extensively cross-examined by the defendant.
