2 Such compulsory payment to avoid forfeiture of the right to possession did not effect a waiver of tenant's entitlement to appeal that portion of the judgment and does not render the issue moot. (Lee v. Brown (1976) 18 Cal.3d 110, 115-116, 132 Cal.Rptr. 649, 553 P.2d 1121.)
