6. Berens v. Ludwig (N.D.Ill 1997) 964 F.Supp. 1215, 1219, affirmed in Berens v. Ludwig, supra, 160 F.3d at p. 1147, which primarily concerned the period during the appraisal process, held that the plaintiff was not entitled to prejudgment interest on any amount under federal common law because he did not prevail in the lawsuit.
