The following excerpt is from People v. Ramirez, 109 Cal.App.3d 529, 167 Cal.Rptr. 174 (Cal. App. 1980):

In these circumstances the trial court also acted properly in instructing the jury on conspiracy. It is not necessary for a conspiracy to have been charged. (People v. Teale, 63 Cal.2d 178, 188, 45 Cal.Rptr. 729, 404 P.2d 209; People v. Joines, 11 Cal.App.3d 259, 269, 89 Cal.Rptr. 661.)
