The right of a defendant to confront witnesses at pretrial proceedings is not absolute.

As noted above, courts often conduct in camera situations in criminal proceedings. In these proceedings, the defendant's right of confrontation and cross-examination is subordinated to a competing interest of society. Further, even at pre-trial evidentiary hearings, the defendant does not have an absolute right to cross-examine adverse witnesses. See United States v. Batiste, 868 F.2d 1089 (9th Cir. 1989).
