The following excerpt is from Buchman's Estate, In re, 138 Cal.App.2d 228, 291 P.2d 547 (Cal. App. 1955):
The appeal from that order stayed any further proceedings under it, but it did not revive appellant's letters testamentary which the order revoked, and pending the determination of the appeal from the order, appellant was suspended from office and the court had not only the power but the duty to appoint a special administrator pursuant to the provisions of sections 460 and 465 of the Probate Code.
