It is indeed true that members of a legislative body such as a city council do not have absolute immunity under the Federal Civil Rights Act. (Nelson v. Knox (1958) 6 Cir., 256 F.2d 312, 314.) Their immunity is qualified by the necessity of acting in good faith in the performance of their duties. (Id. at p. 315.)
