The plaintiff has failed to establish that the Minister can probably give material evidence. In order to sustain the summons, it was necessary for the plaintiff to establish that the Minister had material evidence to give in relation to issues that are likely to be raised in the proceedings at trial. (Davenport v. Dobreff [2008] O.J. No. 4070 (O.C.A.)).
