Is a spousal support order valid?

British Columbia, Canada

The following excerpt is from Dorken v. Dorken, 2002 BCSC 1136 (CanLII):

In my opinion the terms of the order do not oust the court’s jurisdiction to entertain the present application. Given the provisions of s. 17(1) a spousal support order can never be truly final. See Pelech v. Pelech, 1987 CanLII 57 (SCC), [1987] 1 S.C.R. 801.
