In Desgagne v. Yuen, 2006 BCSC 955, the plaintiff suffered a brain injury, chronic pain and fatigue following a motor vehicle accident, as a result of which the plaintiff alleged cognitive dysfunction including difficulties with concentration and attention. The defendants sought production of the hard drive from the plaintiff’s home computer, his palm pilot, and his video game unit.
