How have the courts interpreted the block fees in the costs grid for preparation fees during trial?

Ontario, Canada

The following excerpt is from Celanese Canada Inc. v. Canadian National Railway Co., 2005 CanLII 8663 (ON CA):

In Dybongco‑Rimando Estate v. Lee, [2003] O.J. No. 534 (S.C.), in a case where more than one counsel appeared for the successful party, J. W. Quinn J. understood the block fees in the costs grid “to be per counsel and not global amounts” and that they did not include a counsel fee for preparation during trial, which he allowed because he considered it to be appropriate.
