In Cardoso v. Cardoso, [1998] O.J. No. 842 the plaintiff had failed to fulfill disclosure obligations. Kiteley J. indicated that a defendant has rights to full disclosure and she dismissed the action where those rights had been undermined and resisted by the plaintiff.
