The following excerpt is from Blanchette v. Mullins, 2007 CanLII 23329 (ON SC):

A Defendant will be held liable, regardless of his degree of fault, so long as the act of publication is intentional or negligent. See: McNichol v. Grandy, 1931 CanLII 99 (SCC), [1931] S.C.R. 696. This principle will apply unless the Defendant can succeed on one of the recognized defences.
