The following excerpt is from Farrell v. Barrie Police Services Board, 2011 HRTO 1442 (CanLII):

In some circumstances, a negative job reference can give rise to a claim of discrimination with respect to employment. See Chedore v. McBoyco, 2010 HRTO 2131. However, in order to proceed with her claim, the applicant must provide a factual basis that, if proven, could lead to a finding of a violation of section 5. I do not find that such a finding could reasonably be made here, based on the facts alleged by the applicant.
