In Teplitsky, Colson v. McCrea,[3] Strathy J. considered four issues relating to whether an impugned retainer agreement provided for a contingency based fee, and the consequences if it did. The only one of those issues relevant here is whether the agreement offended the Solicitors Act on the basis that it was a contingent fee agreement that was not in writing.
