The defendant submits that the plaintiff should not be permitted to seek particulars of the legal or evidentiary basis on which the defendant resists this order: Hoy v. Medtronic Inc., [2004] B.C.J. No. 676 (S.C.). An order for particulars with respect to the “wilfully false statement” would require the defendant to reveal that evidence.
