In what circumstances will a plaintiff be barred from the community in which he has practised for 10 years?

British Columbia, Canada

The following excerpt is from Salloum v. Thomas, 1986 CanLII 1238 (BC SC):

In my judgment, the covenant under consideration in Deacons v. Bridge was much more narrowly drawn and I distinguish that case from the one before me on the basis of the widely drawn prohibition here where the remaining partners are insisting that a retiring associate be virtually banned from the community in which he has practised for the last 10 years for one foil year from the time that he withdraws from his association, Is that reasonable or necessary to protect the legitimate interests of the remaining partners? — I think not.
