In a pre-FLA case, in what circumstances is a condominium claim enforceable?

British Columbia, Canada

The following excerpt is from Shinatani v Tang, 2017 BCSC 1938 (CanLII):

In Corlett v. Hoelker, 2012 BCCA 355, another pre-FLA case, at issue was a former wife’s claim to a condominium in Vancouver. The wife was a Canadian citizen who by then resided in Vancouver but during the marriage had lived with the husband in Arizona and Washington State. The couple acquired the condominium during the marriage and the wife moved into it after the separation. They also acquired other properties elsewhere in the United States.
