The following excerpt is from Pastor v. Chen, 2002 BCPC 169 (CanLII):
The case of Seager v. Copydex Ltd. 1967 RPC 349 held that the Defendant company had made use, albeit honestly, of information which had been received in confidence and which was not available to the public; they were accordingly liable for breach of confidence, and the plaintiff was entitled to damages, assessed on the basis of reasonable compensation for the use of the confidential information.
