The applicable substantive law to a contract is determined first by the expressed intention of the parties; in absence of an express intention, then by the implied intention of the parties; and lastly, if necessary, by the system of law with the closest and most real connection to the contract. Herman v. Alberta (Public Trustee), 2002 ABQB 255 at para. 6-7

Consent to service may be vitiated if one does not understand the potential legal effect of giving consent. Sidhu v. Sidhu, 2014 BCSC 296 at para. 40
