The first issue succinctly stated is whether the applicant is an owner under the Condominium Act? As stated by the respondent in his factum and based on the decision in Kim v. Trump, the applicant sold her unit on September 23rd, 2015 and commenced this application on May 26th, 2017 and thus she was not an owner and has, therefore, no standing.
