In Bagaco v. Union Energy Limited Partnership [2009] OJ. No. 673 (S.CJ.),,76 C.P.C. (6th) 314, Justice J.E.Kelly addressed an attempt to combine numerous defective water heater cases in the same action. She concluded that as the claims arose from separate transactions and the joinder of all the numerous claims would unduly complicate or delay the hearing, joinder was inappropriate.
