In cases involving soft tissue injuries and chronic pain with no medically objective findings, the plaintiff’s credibility as to her ability to function at work and at home is a paramount consideration. The plaintiff has the onus of satisfying the court on a balance of probabilities of her claim of pain and consequent losses, and that, but for the Accident, she would not have suffered the injuries she alleges: Clements v. Clements, 2012 SCC 32.
