This amended class definition will include clients whose claim may not be provable, but that is not objectionable. A class definition is not unacceptable simply because it may include persons who ultimately will not have a claim against the defendants, as determined at the common issues trial: Bywater v. Toronto Transit Commission, supra at para. 10.
