It is reasonable to expect “that the certification battle is likely to be both lengthy and expensive”, and that “a defendant will respond to a certification motion utilizing all of its available effort and resources”, since “a class proceeding represents a significant risk to a defendant given the enormous potential liability that attaches to such claims if the procedure is certified”: Gariepy v. Shell Oil Co., 2002 CanLII 19450 (Ont. S.C.), at para. 5.
