The issues of statutory interpretation put forward by CIBC raise questions of law, reviewable on the correctness standard. The proper application of the term “administrative service” involves a determination of mixed fact and law. Unless there is an extricable question of law, it is subject to review only on the highly deferential standard of palpable and overriding error: Housen v. Nikolaisen, 2002 SCC 33.
