In Chitel v. Rothbart, [1984] O.J. No. 2238, the court began hearing submissions on a long motion on one day, and adjourned to the next day to continue the hearing. On the next day, one of the parties sought to file an affidavit which had been prepared overnight, something the court refused, observing that it would be “essentially unfair” do to so (para. 34).
