In Vivian v. Courtney[12], the father brought a motion in 2009 to terminate child support on the basis that the child was no longer a child of the marriage and for the return of alleged overpayments. The mother sought to adjust child support to the proper guidelines table amounts consistent with the father’s higher income retroactive to January 2005. The child was found to still qualify as a child of the marriage under those circumstances.
