How have courts interpreted s. 18 of the Child Support Guidelines?

British Columbia, Canada

The following excerpt is from Younger v. Younger, 2017 BCSC 363 (CanLII):

In Kowalewich v. Kowalewich, 2001 BCCA 450, the court provided helpful commentary on the use of s. 18 of the Guidelines. The commentary starts by setting out the purpose of the Guidelines generally, at para. 42: The purpose of the Guidelines is to permit an impartial assessment of “money” available to a spouse to pay child support. They are not just about actual income as a parent directly or indirectly determines it to be.
