Section 16 requires the court to consider the best interests of the children and to give effect to the principle that a child should have as much contact with each spouse as is consistent with those interests. The court may order sole or joint custody. Joint custody is appropriate where the parents have shown that they are able to make joint decisions for the children and where it is likely that they will agree on important issues affecting the children’s welfare: Abbott v. Abbott 2001 BCSC 323, at para. 17.
