On an appeal from a child custody order, the court can overturn or vary a lower court’s decision only where there has been a material error, a serious misapprehension of the evidence, or an error of law. See: Van de Perre v. Edwards, 2001 SCC 60; Hickey v. Hickey, [1999] S.C.R. 518.
