It has been recognized that Canadian maritime law applies to incidents involving non-commercial vessels that occur on wholly inland navigable waterways and in that regard, I refer to the decision in Whitbread v. Walley, 1990 CanLII 33 (SCC), [1990] 3 S.C.R. 1273 at pages 1294 to 1295.
