The leading cases on s. 6(2)(b) are Skapinker v. Law Society of Upper Canada, 1984 CanLII 3 (SCC), [1984] 1 S.C.R. 357, and Black v. Law Society of Alberta (supra). In Skapinker, Ontario legislation required Canadian citizenship as a condition of membership in the bar. Skapinker was a permanent resident of Canada and Ontario who met all the necessary requirements except for citizenship.
