While the Convention is binding on all contracting states as a matter of international law, in order to make it effective within Canada it is necessary to enact legislation or appropriate rules. For matters under provincial jurisdiction, this requires action by the provinces: see Attorney General of Canada v. Attorney General of Ontario, 1937 CanLII 362 (UK JCPC), [1937] A.C. 326 (P.C.).
