The test to be applied in determining whether the Minister's surrender order violates s. 7 of the Charter is whether it "sufficiently shocks the Canadian conscience" or if it is "simply unacceptable". See Kindler v. Canada (Minister of Justice), 1991 CanLII 78 (SCC), [1991] 2 S.C.R. 779, 67 C.C.C. (3d) 1; and United States of America v. Earles (2003), 171 C.C.C. (3d) 116, 2003 BCCA 20.
