The following excerpt is from Miller v RBC Dominion Securities Inc., 2021 BCSC 1811 (CanLII):

A breach of duty (such as non-compliance with rules and regulations) does not, in and of itself, give rise to liability. In a negligence claim, a plaintiff must still prove that the breach caused the plaintiff to suffer damage. See Junko v. Canaccord Capital, Toles, 2012 ONSC 6966, at para. 52.
