Can uncharged sexual misconduct be used to corroborate a victim's allegation of sexual abuse under section 803(g)?

California, United States of America

The following excerpt is from People v. Yovanov, 69 Cal.App.4th 392, 81 Cal.Rptr.2d 586 (Cal. App. 1999):

Given the significant probative value of uncharged sexual misconduct in sex crimes cases, we find evidence of such can be used to corroborate a victim's allegation of sexual abuse under section 803(g). Of course, the precise probative value to be accorded this evidence will depend on various considerations, such as the frequency of the uncharged acts and their similarity and temporal proximity to the charged acts. (People v. Soto, supra, 64 Cal.App.4th at pp. 989-990, 75 Cal.Rptr.2d 605.)
