hearing on the new trial motion as part of the record on appeal.10 In its minute order granting defendant's new trial motion, the trial court relied on evidence adduced at trial to rule that defendant was prejudiced by the jury misconduct. Plaintiff did not designate the reporter's transcript of the trial as part of the record on appeal. Accordingly, appellant has failed to provide an adequate record on appeal. (Vo v. Las Virgenes Municipal Water Dist., supra, 79 Cal.App.4th at p. 447.)
