With regard to state law, though the prosecutor may not have intended the statements to deceive, they appear to have been intended to persuade the jury of defendant's guilt based on matters not in evidence. As a result, the statements constituted misconduct under state law as well. (People v. Morales, supra, 25 Cal.4th at p. 44.)
