Can a police officer stop and pat-down on a passenger at a bus stop in the middle of the night?

California, United States of America

The following excerpt is from People v. Szabo, 107 Cal.App.3d 419, 165 Cal.Rptr. 719 (Cal. App. 1980):

The detention and pat-down were not based on rumor, curiosity or hunch, but under circumstances that made the officer's course of action necessary to the proper discharge of his duties. As a reasonably prudent man, he was warranted in the belief that his safety was in danger. (Terry v. Ohio, 392 U.S. 1, 88 S.Ct. 1868, 20 L.Ed.2d 889.)
