The following excerpt is from People v. Scheu, 177 Misc.2d 922, 677 N.Y.S.2d 904 (N.Y. Dist. Ct. 1998):

A police officer may make a non-pretextual stop of a motor vehicle if the officer observes the vehicle commit a violation of the Vehicle and Traffic Law, or if the stop is part of a valid nonarbitrary, nondiscriminatory, roadblock or check point, conducted under uniform procedures. People v. Clive Spencer, 84 N.Y.2d 749, 622 N.Y.S.2d 483, 646 N.E.2d 785 (1995). That is not the case here. This case involves a claimed stop of a motor vehicle based upon "reasonable suspicion" that the occupants of the vehicle had committed a larceny, and had absconded from the scene of the crime.
