Can a jury misuse the evidence to find a defendant guilty?

California, United States of America

The following excerpt is from People v. Ornelas, F074019 (Cal. App. 2018):

the jury misusing this evidence to find him guilty. (See People v. Henderson (2003) 110 Cal.App.4th 737, 742 [noting that the predecessor CALJIC instruction "serves the dual purpose of permitting an inference of guilt, but at the same time provides the defendant with some protection against misuse of such evidence"].) We presume the jury followed the court's limiting instruction, and there is nothing in this record to rebut that presumption. (People v. Waidla (2000) 22 Cal.4th 690, 725.)
