Defendant asked the trial court to strike the prior strike under People v. Superior Court (Romero) (1996) 13 Cal.4th 497. In the burglary, defendant and others entered the backyard of a residence, broke the sliding glass door, and removed various items from the house. Nothing indicated the victim was present during the burglary. Defendant was convicted of first degree residential burglary ( 459) and was sentenced to 300 days in county jail and five years of formal probation, which he successfully completed. He was 20 years old at the time of this offense.
