In Burke v. Leung, [1996] B.C.J. No. 938, the court found the defendant driver not negligent after he had struck the plaintiff who had run quickly into the street without regard to the traffic on the street while the driver was proceeding through the intersection “at a safe rate of speed of approximately 15 to 30 kilometres per hour”.
