The panel in that decision determined that the “rule” is one of practice and not of law. It is a matter of weight to be decided by the trier of fact. The panel did not strictly apply the “rule” in Browne v. Dunn, but took it into account in weighing the evidence. I agree with that approach and have adopted it in this appeal.
