Further to that submission, petitioner’s counsel argued, relying on Jan Matous v. Superintendent of Motor Vehicles 2003 BCSC 1531, that the Breath Test Tickets should be excluded from consideration by the adjudicator and a re-hearing of the review be ordered with a direction that the adjudicator not consider the tickets.
